My girlfriend has a 5 year old daughter with her ex who lives in Florida. My girlfriend was together and lived with him for close to 8 years. Things got bad so she broke up with him and moved to be with her family in New york. We met while i was on vacation and have been doing a long distance relationship for almost one year. I live in Kentucky. She wants to move here to be with me in Kentucky. Her ex is an asshole and doesnt want her to move here. Can her ex stop her from moving to Kentucky bc they have a child together? Any advice would help..we dont have the money to live in Florida.

Yes, he can stop her from moving her child to a state that he has not approved of. She will need to go back to court to get an order to allow her to move with her child.

It truly depends completely on the child parenting plan. If their is one. If she does not have court orders to stay in Florida-with the child, she can go where ever she wants. This is assuming she also has full custody of the child. Only under these terms can she legally leave. If she has joint custody, she cannot leave. Other than that, I guess it would be a good ideal to consider the child's feeling and what it might do to her emotionally. That call would be the mother, she would know best. Good luck!!

A lot depends on the custody arrangement, but in general, I would say he can not stop her from moving to Kentucky.

Most of the time, cases like this involve a custodial parent moving away from the non-custodial parent, thereby interfering with the non-custodial parent's visitation. As he has already let her leave Florida to move to New York, it would be hard to use that as a basis for complaint, especially as she is moving closer to him.

I don't see any way he can prevent it.

okay...let's see. you live in Kentucky, she lives in New York. the father lives in Florida. he can protest all he wants.....(just to be an asshole) but the judge will laugh so hard he might pee. my geography isn't the best, but off hand isn't Kentucky closer to Florida then New York? he would have to come up with a really good case and bring johnny cochran back from the dead to talk a judge into her not allowing her to move.so he can protest.....but the chances of winning such a stupid issue is almost nil.

He can stop it ONLY if they have a legal custody arrangement. For example, in the paperwork to my custody case, it specifically says that neither me nor my ex can take our child from the state. If they have not gone to court, then yes she can do whatever she wants.

Evidently she has custudy of her daughter so she can move wherever she wants to as long as there is nothing in the divorce that says she can`t.

Only if he has custody or joint custody. She needs to try and get full custody of the child.
