The answer depends on where the fence sits-- on your lot (you fix both sides of the fence), on their lot (you do not fix anything), or on the property line (you fix your side and they fix theirs). See your property survey, or contact your lawyers office. good luck.

Generally, if the "nice side" faces out on his property, then it is his fence to repair. But in an effort to promote a good neighbor policy, you should go over and discuss the repairs of the fence with him and offer to split the costs for the section which adjoins both properties. If he doesn't want to repair the fence, then I'd do just what it takes to secure your dog and let the rest go if you don't want to buck up for the entire cost.

Animal control departments don't normally put down dogs for chewing through a fence. You absolutely should call your local animal authorities and they will see to it that the owner fixes the fence. Those dogs sound like a serious problem waiting to happen. Pit bulls can kill people, particularly children, suprisingly easily - if they latch onto your neck, they don't let go until they sense you're unconscious, and by that time it may be too late. In some cases, the dogs have to be shot or tranquilized to make them let go. As for angering your neighbor, how much concern is he showing you and your neighbors by not fixing that fence? It doesn't sound like he gives a damn about you, so why should you be so accommodating to his less-than-earnest attempt to corral his viscious animals.

More than likely the responsibility for maintaining the fence is yours since the 'nice' side faces your lot. A definite answer can normally be found through the local building department to verify the person who pulled a building permit for the erection of the fence. That being said, you are responsible for securing your pet on your property. You must make any repairs necessary to achieve this. Keep a receipt of any and all repairs you undertake and if it turns out that you neighbor is responsible for the fence or if it turns out to be a community owned fence you can seek reimbursement from them.

Depends on the location of the property line in relation to the fence. If on the property line you both should share costs. Don't know what the law is for your state. In my state the neighbor can be compelled in court to pay for half on a fence on the property line or accepted boundary fence.
Contact local city hall and or legal aid office.

If you can check the property lines that will determine the owner and thus the onus of the repairs. It is common practice to approach the other party to a shared fence and ask them if they would like to share in the cost and or repair. After all, you could always just take it down if it's yours. ;) That very statement may help them make the decision to help you out. The DO benefit from after all. One last thing, if they do agree -get it in writing! LOL

To assure that you get the nice side of the fence you need to replace it. It would be nice if they would share the cost but most neighbors will not.

Ok,you have to determine who OWNS the fence.......one of you does,find out who,and if it IS yours,you are not responsible to fix it if you dont want to. Have a nice talk with your neighbor and see what you can do to remedy the fence situation amicably. If you own the fence why should he fix it......get my point? And if it is HIS fence,why should he fix it at your request.....Get this resolved with the least aggrivation.

if your dog ruined it it's your baby but if it's just in disrepair it's the owner of the fence that may be you or it could be your neighbor if in doubt get it surveyed
