He has been with her for 3 years.. she has not contributed to the up keep of the home but has been there for the children... they are separating very soon and i was just curious if she was entitled to really anything... she has no kids... he works shift work and she will be taking them (offered) two weeks while he is on afts. I think it would be concidered daycare...

depending on the state, she may be eligibale for palimony. but she is definitely entitled to child support.

I really don't see a judge ordering support other than for the two weeks she has the kids. So, based upon his income and if they use the DHS Child Support Guidlines, it would only be half of what he would be ordered to pay a month in full child support, and if she works they will include her income as well.

The answer is NO. The commonlaw girlfriend is not entitled to child support if she has no children.

They should work out some compensation for the two weeks she will be primary caregiver, but they're not her kids, so she is not entitled to child support.

Your wrong in pointing out that she hasn't put towards the upkeep, unless she just sits on the couch all day, watches tv, doesn't do housework.

SHE can sue for ALIMONEY though.....so if she's been kind enough to offer, and has cared for these kids, more power to her in getting alimoney!!
