I can really use some help here. I was recently arrested for public intoxication but was never given a breathalizer or sobriety test. How cant this hold up in court? it is my word against the officers. Also i am planning on applying to med school next fall, does anyone know if this charge can have a big impact on me getting into med school i am really freaking out about this more then having to pay a fine or community service.

The stupid cops have ways of recording everything they do. If you try to tell the court that the cop was lying, then you are really going to look like a lier when he/she breaks out a video. Just tell the court you where going threw a tough time in your life and didn't realize you had drank so much. Be honest (for the most part) and if it's your first offense then, they will let you off with just a few hours of community service and no record. As far as med-school goes, as long as you don't have any felony's then you have as good of a chance of getting in as anyone else. Good luck

How drunk were you? If you are intoxicated enough that you can't stand, are slurring your speech bad enough, etc, then there is no need for a breathalyzer or sobriety test. You weren't driving obviouly, which is when a breathalyzer is needed. If you showed all the signs of being intoxicated, and are in public, well, you're guilty.

I would say it depends in the Med School as far as your chances of getting in. If this is a one time thing, and your grades/ transcripts are good enough, then maybe not. If this is something that happens a lot, then probably. Apply anyways, be honest, and see what happens.

The law states you have to be proven quality without a DOUBT!! So, I hope you did not plead guilty! Get a lawyer, even a public pretender-if you cannot afford one-one will be assigned to you.Should happen when you plead NOT GUILTY! Stick by the fact that you were NOT intoxicated-all the way down the line. If NO legal test was taken to see what percentage of alcohol was in your system, this will not hold up in a court of law. Not in front of a jury anyway! Having 1 beer is NOT being intoxicated-get it??????? Your breathe might smell, but that still not not mean you were intoxicated! Would be even better if you have a witness stating you only had a beer! Keep in mind, you can only have a percentage of alcohol per hour, per your weight-according to the law!!! Good luck. GO TO JURY TRIAL!!!!!
