So I have been working with this company for awhile now and have had some problems before. One year, we didn't receive our W2s until about a month after the government set deadline.

Now, here recently some people are getting paid for holidays and others aren't. I got my Thanksgiving holiday pay (time and a half) and another girl is still trying to get hers but keeps getting the run around. I also got my Christmas pay, but I got it late and there is another person still trying to get theirs. However, no one got paid for New Year's even though we worked holiday schedule.

And also, normally I get direct deposit but they didn't deposit my check and never let me know that it wasn't going to be put in so I was spending money like I had it in the bank. No one said anything to me and I didn't find out until I got an overdraft from the bank.

I have also worked overtime this past week which I did not get pay for.

Who would I go to about this? Should I check with the better business?

The Labour Standards board is the place to call. In the USA, the Better Business Bureau may serve this function, I do not know. Either way, contact the government department in charge of labour laws. They take the side of the worker, and complaints can be anonymous (especially if an entire group missed their pay). I've always been able to collect the money I've been owed. Make sure you have pay stubs and bank statements available to prove that the money was never in your possession.

The Better Business Bureau is mostly useless in these situations. Contact the labor bureau for your state. You would do this by looking at the state government's website and figuring out what agency handles labor/employment issues. Usually there will be a contact number for reporting these types of problems. At least get the main number for the agency office and they should direct you to the right people.

You should be warned that as part of this inquiry, they may want your name, etc. If you want them to act upon the employer, you will want to know your rights about being protected. Sounds like your employer is a real jerk though...ever thought about getting another job?

many questions that require many answers. check with your immediate sup`r first, then work up one grade only, try to find out why the required paperwork is not being sent in/out properly, are you or the others leaving anything out, is the paperwork being filled out properly, if you have a union steward check with them too and write down your answers completely and accurately, keep detailed records of time and date as to whom you spoke or wrote, keep that info segregated from anything at work, as safe and secure as can be. you will be needing legal assistance when you get all of the answers in stock, if you are doing it allone, tread litely, check with your payroll dept see if they have any records of the money getting sent elsewhere that was unapproved, if so add that info to the legal pile, you do have recourse and $$ coming to you, good luck

Better Business is for customer complaints.
State Labor Board is for enforcing labor violations, and in California, they will handle the collection if violation is proved.
