My Bank of America account had money taken from it due to a check sent through from Citibank. I did not authorize citibank to take money out of my account, nor do I have any affiliation with them; no cards, loans, etc. I had BofA send me a copy of the check ($2 to do) and then called Citibank. Citibank showed that I had no accounts with them, therefore they wouldn't do an investigation to it and basically told me I was out of luck. Because it was a check that appears to be authorized by me, BofA can't refund my money. They sent me the check, so now I'm taking it into a banking center tommorrow. Even though when I originally called the center and I told them I would be bringing it in, they said it wouldn't do much because they don't know where the check came from. This has become a stressful headache, should I sue?

Wow....who's Citibank acct was it paid to...usually one does not just pay Citibank, you have to include an acct number? Have they told you that yet?


BofA should investigate this per your request. You will have to sign an affidavit that YOU did not release or approve of these funds to be removed from your acct.

Document everything you do...writing down who you have spoken to and when.

If you are not satisfied with an answer you get from the person you are speaking too at a company, don't ever stop - especially when you have "evidence" in your hand on what your speaking about is true! Talk to their MANAGER! Keep going up the ladder until you get your point across, but do make sure you know what you are talking about. If for some odd reason, this does NOT work, send copies of your evidence and thoughts to that business firm CERTIFIED MAIL, and wait a couple weeks for a response. Let them know at that point you will be seeking help from the Attorney General or Better Business Bureau for legal help if they do not respond within two weeks. I am positive you will get your response. Good luck!

Who would you sue and on what grounds?

Who endorsed the check or whose Citi account did it go to?

When you go into the bank, tell them that the check was fraudulent. BofA will open an investigation to get your money back to you. That will take 90 days.

I would consider consulting a lawyer. Many law firms have free consultations, and I would take advantage of this. Your ? was pretty detailed, but I would take all this info with you, maybe even type it up nice and neat, and then take any pertaining paperwork from your bank to the lawyer. Good luck

just go to urs bank and find the all details regarding this then take forward any decision against them if then not solving urs problem then lodge the case against then in consumer court
