my husband pays a crap load in alimony and he has about $4,500.00 in arears. NOT because he hasn't been paying, but because his exwife (the b****) took him back for more and got it and she had it back dated and now he is in arears! my question is... in the state of ohio can she get OUR federal tax return? I know she could if it was child support, but can she when it's just alimony? i have looked and asked, i'm not getting anywhere. i just hate this woman! ( i know it's wrong to hate) but come on!

Yes, she can get HIS portion of the tax return. If you find that she's received the entire return, you need to file the Injured Spouse Form with the IRS. The IRS has the form on their web site.

yes she can get the money that she deserves. i know that you do not want to hear it, but the reason that his child support was increased was because his income increased. might as well get used to it. his kids come first in the eyes of the court.

maybe next year, you should file seperately if you have such a problem with it, or encourage him to PAY his child support.

I don't know but you have gave me an idea to tell my daughter.She still gets the same amount she was getting 9 years ago.Good luck to you.
