my friend, his name is Bob is 16 yrs old. His father lives in Florida and Bob used to live in California with his mother, but ran away from home because she often physically and mentally abused him and child services never did anything about it. Bob is a smart kid, perfect grades, dreams of being an engineer...in fact he even skipped 2 grades and is graduating high school this year.
Bob plans on attending an Engineer school after high school in California and could use the child support from his father to help him but right now his mother gets the money and uses it to buy marijuana and alcohol as she only has a part-time job herself.
Is there any way for Bob to recieve the child support money from his father directly so the mother doesnt get it? Is this possible? would the courts allow this?

yes he can, but he needs to be willing to fight for it. that child support will continue while he is in school (college too).
1) he needs help; tell him to contact his local legal aid office. every state has one and is in most counties. they go on a sliding scale so its free to most. look in the phone book, call his county court clerks office or his states Bar Assoc for the number.
2) he needs to prove what a good student he is. he needs copies of his school records.
3) he needs proof that he no longer (or hasnt been living with the mom) lives with the mom. he can get a notorized letter, copy of lease, utility bills, etc.
4) any proof of her abuse (the case workers name, case number, etc from social services) would be helpful.
5) he can ask for a court order to send the support to him, as well as support from his mother. BOTH parents should be paying for his needs right now.
he will need to go to court and prove these things (and more). he will need an attorney or rep of some sort.
why didnt he go live with his father? just wondering.

No because Bob is a minor. Bob might be able to get the money if he was living with his dad and his dad decided to just give him the money. Maybe get a video camera and document some of the abuse for child services. Be careful though because if they take Bob away from his mother he could end up in some lousy boys home. Good Luck to you and Bob. Bob also probably needs to stay in California if he wants to go to school there and pay in-state tuition.

Your friend needs to go to legal aid where he can find out about the laws in his state. Generally, if the child is no longer living at home the father can quit paying child support to the mother. Is there a reason why Bob is not living with his father? I admire Bob for getting out and for his goals to become an engineer but I hate to see him out on his own at such a young age...a time when he should be having fun. You sound like a good friend. Bob should check with an attorney about his rights as a minor. Why doesn't Bob contact his father explaining the situation and see if they can set it up with the courts to have child support paid directly to him?

He needs to get the advice and help of a lawyer. There should be away that the money can be put into an account and with a trustee in charge. It should be someone who would have Bob's best intrest. It doesn't have to be a family member. It could even be a lawyer.

Bob's father would have to go to court and have the order changed for Bob to be paid. However PROOF of your claims against the mother would have to be shown. Orders aren't changed just on accuasations alone.

This almost sounds like he is going to have to see and attorney for advice. I would think that the court could have the child support diverted to the clerk of court and have a guardion pro tem appointed to administer the funds for his benefit.

Actually yes.
I think your friend needs to make a call to his father and tell him what is going on and ask him if he would help him become emancipated.

I believe once he starts attending college and moves out he can collect the money himself. I would suggest that he contact an attorney and ask for legal advice.
