My car was parked outside B&Q which is a free car park in a disabilty space. On return to my car I had been issued with a £60 fine for not displaying badge. As it was a very windy day it had blown onto the floor as I got out off the car unnoticed. Is this legal as the car park is free anyway and how can they justify the £60 fee.
Any advice would be gratefully appreciated.

It is a free parking area, but to deter people from parking in Disabled bays who are not diabled they will put aticket on cars that do not show a disabled badge. They did not know you were disabled and therefore they gave you a ticket. They acted correctly and your only hope is to explain the matter and hope that you get off. The "badge " law states that you must always display your badge if you park in these bays.

Who issued the ticket? If it was the B & Q then complain to them. If it was the coucil's parking enforcement unit then the offence is of not displaying, which you admit, could be a bit tricky to overturn. It is possible. A word of warning. Westminster City Council is the only area that does not recognise disabled badges, never park there without paying. Good luck.

Agree with mindbender on this one.It is up to you to make sure your disability badge is displayed.No badge means illegally parked,hence the fine.You cannot expect the warden to peer through windows to see if badge has fallen onto floor.As stated you would sharp complain if able bodied drivers were stealing your parking spaces,so their has to be a deterrent,hence the fine.Mind £60 seems alot,B&Q need to look into this,must be a better system surely.

Bad luck.As has been said, it's a private car park and probably "policed"by a contracted company.So the manager of the store should be your first call.For future reference, following a similar incident my partner Blu-tacked his badge onto his dashboard so it's always there whether it's required or not.Further to the reply from retep g.-------- if any company threatens to come round to your house and remove goods, they are breaking the law.They are not allowed to threaten, bully, harrass.They should be reported to the local Trading Standards Office at the local council who will write to them or if you're really lucky, Prosecute them.!Hope retep g. is checking back to see your other answers.

If there was no visible handicap card or license plate the ticket was properly written. You wouldn't like it if all the handicap spots were taken by unlicensed vehicles.
Just go to the police station and show them that you have a card and explain the issue. They will most likely take it off the books rather than waste the courts time because they know you have a permit to park there.

To be fair, if your badge wasn't displayed it wasn't displayed - that's not the attendant/warden's fault.
If it's B&Q's own car park, have a word with the manager, tho' I expect you'll find the rules are enforced by a contractor, who are often less than interested. A polite discussion usually bears more fruit than a shouting match.

All this talk of court scares me - you should be able to resolve it way before that stage.

Is it a public car park or highway? If so the ticket was issued by the local authority or one of their subcontractors - appeal according to the procedure that will be on the ticket and ensure you enclose a copy of your disabled badge.

If it’s a private car park you’ll need to contact the contractor to discuss it – to be honest they’re usually less lenient. So I’d consider talking to the manager of the B&Q store and explaining the situation. If you get no joy, inform him/ her that you will go to the local paper with your story – they’re unlikely to be happy about the adverse publicity and will most likely overrule its issue.

You must send a photocopy of your badge with the PCN number to the address on the back of the ticket and once they have checked it and validited your right to park there, the fine will be cancelled. It is not illegal as you were parked incorrectly. I suggest buying a holder for your badge and then it will stay put!

i am blue badge holder as well why not invest the £5 to purchase the wallet to put your clock and badge into to stop this happening sorry its your responsibility to ensure badge is displayed at all times to many people are abusing the system and genuine folk are being labelled the same,this is parents who's children have the blue badge and they are at school and parents think its OK to use its not the badge holder must be with the vehicle.that is fact of t&c.

Write to B&Q and complian as a long standing customer,get your Doctor to write a letter of comfirmation about your disability and put it with your detials of disabled badge( photocopy badge and everything)send copies to Parking Authority with letter of explaination,ask B& Q if they employ the Parking Authority ?If push comes to shove you might have to use the local papers and your M.P.all the best John Boy.
