We hit a tree and were not hit by anyone else. On what grounds would I need a attorney for? I do suspect the ABS was not working and especially since it stopped working just a few weeks ago and had to be replaced. I am not sue happy but I am badly injured with no insurance. At the time I had medical so we opted out of the Auto medical. Since then I lost my medical now I am screwd I guess or since I was a passenger will they cover my medical. Thats all I car about is the medical.

Actually when we picked up the car after the ABS getting fiuxed we got home and realized one of the tires were flat and the rim was bent. We had no choice but to put fix a flat in it. They bent our rim we believe and they rotated our tires to put the Balder tires on the back. Blad tires might not help that case much but again I am only concerned about the medical and as for the property owner they live on 25 acres and I dont think they are concerned about that one tree. U never know though but thats the least if my worries. Technically yes it is my own car since we are married so I dont think they will cover the medical. ****

if the abs stopped working and you had it replaced and it still wasn't working then you have grounds for a lawsuit either against the mechanic who replaced it or the actual manufacturer which may have made a faulty abs. either way it was not your fault and as such the responsible party or their insurance should pay. its not like they did it on purpose, accidents do happen but Pol still have to pay for their mistakes whether intentional or by accident. get an attorney and have the abs system checked out. since you don't have insurance at the very least have your medical and car replaced and don't discount your injuries. you may feel ok now but years from now, how will you feel. i know a woman who sued from a accident and got close to a million bucks just for a sprained ankle and that was after all the medical costs.

You should get the brakes checked out by an expert they could have failed again. Secondly was the tree on private property? If so the property owner could sue you and your wife. You were a passenger in your own car with your wife driving they will not cover you medical. What it boils down to is get an attorney, he will make sure that the brakes on the car were fixed and if not he can sue the manufacturer and the installer. He can also defend you if the property owner sues you.

It sounds like the only people you could go back on are the driver and the mechanic. It sure sounds as if you got dealt a low card on the whole medical thing, but at least now you know how important it is to have insurance.

It depends on your wife's insurance policy. If it covers the medical costs of a passenger? Then the insurance company must pay your medical.

The key to anything is information. An Attorney can fill you in. You don't have to sue, but make an informed decision

i dont' think you need a attorney, but i think you need to go to policy office for file, and it means you didn't run over
