I had 2 jobs this year, made a total of $9,021.00 in gross income and according to my return i made up, but didn't file, it said I would be owed a refund of $245.00... My mom made more than $10,000 and wants to claim me as a dependant. According to tax laws, since im under 24 and still i student, she can claim me and get the EIC, however, if she claims me, can I still file my taxes and get back my return as well?

Yes. As long as your parents are supporting you, file 1040 EZ and turn it over to the back to fill out the worksheet. You'll be able to claim part of your exemption even if your parents claim you as an exemption on their return.

(Your parents have to meet all the exemption tests with you as a "qualifying child". Don't use "qualifying relative".)

She can claim you as a dependant until you are 18, or if you are a student, until you are 24. You can still get a return, if you claimed 0 or 1 you will get a return. That return is off of YOUR income and it belongs to you. You cannot get EIC because you are a dependant to someone else. You should still get a regular return though.

If your mom can claim you, on your return you'll check the box that says you can be claimed as a dependent. You won't get all of your withholding back, but you'll get some of it. You will get your standard deduction, but not an exemption for yourself. As long as she CAN claim you, this is true whether she actually does or not, so you have nothing to lose.

You are required to file because of the amount that you earned - it's over the limit where you have to file.

No. You can only be claimed on one tax return. If you are claimed on both returns the IRS will flag it and one of you will have to make an adjustment and pay back any taxes owed. There are IRS rules that govern to determine if you are a dependent or not. Check the IRS website to read the rules on dependents.

yes by law you have to file a return even if you dont' get a refund. because your a student and living with her she can claim you as a dependant, and you still have to file for taxes. you will file as single and she will file married or single or married fileing seperatly or however and just claim you as a dependant. if you need help H&R block are really good tax filers and its quick and they can help you find deductions you didn't know about and help you get more money then what you figured. you can also call them and they can answer any tax questions you may have.

you have to file your taxes either way its just a question of weither you claim yourself as a dependent or not. I believe generally your mom will get more back the the EIC if she claims you.
