The first thing that's wrong is that if you're married and claiming "head of household", you're committing fraud. The IRS has every right to charge you as such and then call you an idiot because you can get a BIGGER refund by filing married joint.
You're allowed to file amended returns for 2005, 2004 and 2003, deadline is April 15 this year. It might be worth your while to see if you can get something more back on those returns. When you turn youself in like this, you don't get penalized, and you're not making nearly enough for them to waste their time auditing you.
You know, you could actually be sitting on a much larger refund if you file all four years at the same time (this year plus the three previous, or whichever ones you think you need to refile.)

You need to know that if you're married, it's illegal for either of you to file as head of household. You are allowed to file joint, which would get you the lowest taxes. Or if you don't want to do that, are allowed to file as married filing separately, but in that case you're not eligible for the EIC. He's filing illegally if he's married to you, lived with you at any time during the second half of the year, and filed as head of household.

If you are married, you can not file as "Head of Household". Every return that he has filed like that is wrong and needs to be fixed.

The only thing wrong here is that you aren't filing joint. The increase in taxes is just due to the tax bracket jump(s.)

Judy is correct & I think good chance IRS will catch this and you will owe a big chunk. y advice go to IRS office & tell them the issue and ask them to help. ALWAYS write down name , title and ph # of who you talk to and save with your taxes for future reference, if IRS employee is rude, unhelpful demand to speak to their supervisor, also you can complain to congressman & often get IRS to act. If you owe back tax and can't pay ask IRS aboutr Offer in Compromise. good luck

No nothing wrong. He makes more money now, so he's in a higher tax bracket. It's simple. The higher tax bracket you're in, the more taxes you pay.

in order to get the higher EIC you have to stay in a certain tax bracket, the higher the bracket the lower the EIC.
