If not, and you're just in the process of a divorce, then you'd file jointly or as married filing separately.

There is an exception. If your spouse didn't live in your home at any time during the second half of the year, you paid more than half of the cost of keeping up your home for the tax year, and your home was the main home of your child for the year and you're able to claim the exemption for the child, then you can file as head of household.

I've been living on my own for 6 months away from my ex-husband. I pay almost double the amount of rent that I originally paid before the separation, I also pay double of the expenses where I reside now and my divorce has not yet been finalized, how would I file my taxes

Married - filing separate. Or if you are not living together, you could file as single. married filing separate is usually for couples who get a better tax break by filing separate instead of joint. So, yeah, file as single.
