I live in Calif and my car was hit at my apartment complex by a drunk, unlicensed, undocumented individual. I have full coverage insurance including uninsured motorist and the insurance is refusing to pay. Is there a recourse I can take?

If you have full coverage which you said than your insurance company should fix your car. Document everything, save copies, keep a journal and anything you mail do it by certified mail with returned signature. Even the worst insurance company will pay the claim with a little of pressure and strategy. The most prestigious insurance will not give you the running around, they just fix it and than go after the other party or insurance.

Do not give up and be a thorn in their rear-ends until they fix your car. Also, you may want to shop around for other insurance, but keep your insurance payments on time and documented as well as a form of precaution. Some companies (prestigious) will not insure or insure at a very high premium if you have not have insurance before prior to requesting it the transfer.

Most insurance does not cover situations where the operator of YOUR vehicle was drunk/under teh influence/performing an illegal act. However you should have "no fault" they should cover it, that or you have to sue said individual, if he's undocumented then you need to sue whoever owned/supplied said vehicle he/she was driving or otherwise "enabled" that person to be here.The dirty secret about "insurance claim adjusters" is they are rewarded with a year end "performance" bonus that is a percentage of the amount of claims they successfully denied claimants. Another wonderful government mandated blackmail you pay for teh privilege of driving, but they have all kinds of ways of getting out of keeping their part of the bargain. Our politicians are well endowed by the insurance industry lobby, that's why locally the insurance companies have reintroduced wolves and panthers to reduce the deer population because so much land is posted deer hunters can't keep the deer population in check anymore.

Ok.. insurance companies dont just "refuse to pay"- they obviously had a reason. You need to calmly go ask your adjuster why they arent paying before you "run off to a lawyer" like im sure everyone is going to tell you to do.

Big insurance companies dont just lay home at night thinking of ways to deny your claim.. usually its peoples own stupidness that makes they not understand why there claim is denied... could it be...

1. Your policy expired before the date of loss?
2. You dont have collision coverage?

And btw.. i have to LOL at the guy who said claims adjusters get a bonus at the end of the year for how many claims they deny. WHO THE HECK IS THIS GUY?! that is the most ridiculous thing ive ever heard. I hate denying claims. No one LIKES to make people miserable. Please dont listen to idiots like that.

Usually if you have comp. and collision...PIP no way!!!
