a muppet is a hybrid marionette / puppet, hence the name muppet

The puppets Jim Henson's Company made, were given the name Muppet's. They are a group unto themselves. Therefore, yes they have to be made by Jim Henson's company. You can contact them if you or someone you know wishes to make some of the characters.
