I had been driving my car at night and was a bit drunk(stupid, stupid) When I saw blue lights flashing so I pulled over. Even stupider I turned off my car and rolled up the windows(paranoid) When the cop came to the window and knocked I turned on the dome light and stupidly opened a brand new bottle of vodka in front of him and started drinking. I then opened the window and apologized. The cop, looked at me for a second and asked me to call my wife to pick me up. After my wife came to pick me up while the cop was holding my keys the cop told my wife that he would have arrested me if he didn't see me take a drink from the bottle? Why is this???

If things happened the way you say, the officer who stopped you is either incompetent, had something of much greater priority to deal with or just doesn't care anymore and needs to get a new job.
The argument that you were sober when pulled over but got drunk as the cop walked up on your car is stupid. Your DUI arrest will be based on your BAC at the time of your stop. Since alcohol does not enter your bloodstream the minute you put it into your body I would use a blood sample for BAC analysis. I would document the amount of vodka missing from the bottle you drank out of and document any other empty or full containers in your car.
After that I would bring you to jail and let the courts hash it out. You can bet that the very best disposition you might end up with would be possessing an open container while operating a motor vehicle.

no proof you drank anything before that.he could have arrested you,but would have had to lie to get a DUI conviction.
