There are 2 categories.

Tax Evasion is knowing and willful failure to defraud the government of tax monies owed. In the case of Federal Income Tax Fraud you could be charged with a felony.

Failure to File is a misdemeanor and has the legal appearance of ignorance or at the least "knowing and willful" can't be proven.

Not paying your taxes. It is usually associated with lying on returns and using falsified financial records.
