Both myself and my wife have names on our car title. But my wife has left the country and is living separately. Can I sell the car with just my signature on the title, or both person's signature are required. thanks

Where do I find if its "AND" or "OR" in the title? thank you

It is going to depend on how the names are listed on the title. If they are listed as John Jones or Mary Jones, then either John or Mary can sign and sell the car. If the title says John Jones and Mary Jones, then both will have to sign, or a court order must be issued to allow the transfer!

Some states do not but the word "and" on the title, but it is assumed to be a joint ownership (requiring both signatures) unless there is the word "or".

fire4511 is correct-if it is worded with "and" you both must sign and if it is signed with "or" just you sign. I just went through this but the title to a boat and it was signed with "and", and my husband had passed away so I had to take his will to court and have it probated. The judge said if it was signed by "or" there would not of been a problem..Contact your wife and have her sign and there should not be a problem..Don't have someone forge it for you because later on your wife could protest this..Hope this helps..

You need her signature on the title, or a limited power of attorney from her to sell the car.

If you forge it, and she finds out, you can go to prison.

Both are required.
Its quite easy to get around that though.. get her to sign the car over to you, and then you can do what you want (can be done by fax).

Edit.. to find out if its AND or OR, see who you had for financing.. the bank/dealer whatever, even if it is paid for. They can tell you who the car was sold to for sure and how it was written as.

It depends on how its worded if it says your name and your wifes name you both have to sign it.If it says your name or your wifes then you can sell it without her signing it.

last i know you had to have both signature
but that was back a few years ago
check with the DMV they will tell you for sure
