Bottom line is, you can't. You entered into a deal and gave a good check as down payment to seal the deal. If you stop payment on the check the dealer can take action against you.

The law is clear, once you sign the purchase order, put financing in place and take delivery, that's it. Once you drive it off the lot it depreciates. Bad deal or not, you've bought a car. If anyone tries to tell you that you can return it in 3 days, don't believe them, that only applies to salesmen that have come to your home. When you walk in their place of business, that 72 hour doesn't apply.

Enjoy your car.

You had better check your state laws. There may be a cooling off period mandated. If not, your girlfriend could be sued for breaking a valid contract, not to mention the charge for issuing an invalid financial instrument if you stop payment on the cheque.

you can call the bank and they can cancel the check anytime before it is cleared. As long as you return the car in the same condition it was in, he cannot legally press charges for this, and it will not affect your credit history.

however, if the check clears, it's between you and the seller.
