married in 2005 but separated and recently divorced, but would like to marry this girl from canada but the problem is, i have to move to canada and my immigration case in the states is still pending, i already have a travel document, should i withdraw my case in the states then move to canada. my girlfriend doesn't ever wish to live in the states and always has asked me to abandon my green card case and move to canada which i have no problem with but just need a few ideas on how to go about it and what complications will rise when i apply for change of status in canada. thank you for your time and input..

If you have an immigration case pending in the U.S. the Canadian Immigration will defiantly know about it as soon as you file or apply of any kind of status in Canada. As an unspoken rule on both sides of the border Canadian Immigrations does not like and VERY RARELY entertain any new cases when there are others pending in other countries and will wait (or dismiss your file until) you make up your mind.

You can keep your Landed Immigration Statues (or Green Card) in the U.S. forever, but you should wait until that is finalized in the U.S. and not apply for anything in Canada until that is finalized.

Just remember getting married to a Canadian no longer means that they will grant you Citizenship or Landed Immigrant Status (like it use to 30 years ago). So they may have the right to deport you if you allow your visas to expire and they also have the right not to extend you visa if they wish to. If you also want to work within Canada and you do not have Landed Immigrant Status you will also have to apply for a work visa and keep that current as well.

Suggestion: Since Canadian law allows couples to be legal spouses without getting married, and also allows dual citizenship, if you want to have a commitment with your girlfriend why don't you just declare (in Canada only!) espousalment until your American citizenship comes through (apparently you seem to want it), and apply for Canadian citizenship (and get formally married, if you still wish that) thereafter?

Not sure what complications will arise, but you should never give up US citizenship. However, if you don't already have it, then you might not be able to obtain once USA knows that you are living out of the country.
