Generally the age is 13. Atleast it is in the state I grew up in. I wanted to live with my father but all custody hearings went in my mother's favor until I turned the age of 13. At that point my father's attorney arranged a meeting between me and the judge in which I voiced my desire to live with my father. At this point there were no more long dragged out hearings like had occured before I turned 13.

Not every court will even listen to what a child wants before deciding at age 12-at age 16 either for that matter. And that's when it's the parents fighting over it. Unless both parents can be proven to be cauing harm to the child or agree for him/her to live with you then there isn't a chance. I may be mistaken, but I'm pretty sure as well that unless you are a family member, even if they are both proven unfit, the child would not be sent to you.

In Ohio that's actual that a toddler 12 or older (or shows the adulthood of a youngster a minimum of 12) could have a say in the place they stay. yet that may not the only finding out factor. The decide will take many stuff into attention, which incorporates an exceedingly unique examine of ways your ex runs his relatives, earlier creating an exceedingly final determination on custody preparations. So the place your son does have rights, his desires are not the be all end each and all the difficulty.

No. but you can file a PINS petitions and ask the court. If the judge finds cause and the natural parents sign off on the child., you may get custody. The age in NY is 14.

Why can't you people elaborate some. Who are you?? that you want this 12 yr. old to live with you?? There are so many perverts out there just waiting to get their hands on a precious little girl. You just may be one of them, no more then you are sharing here.
I don't like the looks of this picture at all. We aren't flies on the wall here. When you send in a question, add a little about why she is not sharing time with her parents. She is their blood and responsibility. This question angers me._______Jill__USA

I think that the child only has to be 13. I have a friend that wanted to move out but the court said that she could not unless she was 13! But the laws may be different in different states! I am not sure.

My child can't. My wife and I would not allow it. I would be concerned with you wanting a 12 year old boy to live with you and not either of his parents.
