my husband is retired from the Army reserve with 23 years, we are living apart. I need to know if I will get a check also.

If he is not 60, then he doesn't collect retirement. If you were not married for at least 10 years of his 23 years service, you are not entitled to any of his retirement. If you do not have a court order stating that you are entitled to half of his retirement(gotten during the divorce) then nope, you will not get anything.

If you are still married.. no, you won't get your own check, even if you are living apart.

That depends on your situation. You siad you are living apart but didn't say you are divorced. If you are divorced and you were married for a certain number of years while he was in the Reserves then you would be entitled to a portion of his retirement. Remember, a reservist does not draw a dime until he turns 60, so if he isn't sixty years old then there is no check. You should check with your lawyer.

While you may be entitled to part of his retirement, he would also be entitled to part of your retirement as well. It is all community property. This is one thing that worked in my favor when I was divorced in Texas. My ex pushed the retirement issue, wanting half my retirement. I let her. She had more retirement with her job than I had with mine. When they added them together, they split it, and I actually got some of hers. That is why I let her push the issue without a fight.

That depends on the court. If you're not LEGALLY separated, no. His retirement will be sent directly to his bank. If you get divorced, the court MAY award you some alimony.
