my fiancé has not worked all year she has been a stay at home mom :) and i have been working but i Cant clam them together because i will not get any money back they will take it all for sure.. Can she still do taxes and clam the baby?? i know it a dumb question but had to ask

Only people who earned income can file a tax return. So your fiancé has nothing to file.

You on the other hand can claim your child (assuming it is yours) as a dependent. This allows you to take advantage of child-related tax benefits including the child tax credit, the earned income credit, the childcare tax credit, and the head of household filing status.

I assume you mean your refund is going to get taken for something you owe. Your fiance can't get anything from filing since she has no income. So you need to file, and take all the credits that you can. Even if you won't see the refund, it will at least pay off part of your debt that way.

You can always go have someone do your taxes up and ask them what the best way would be. If one way doesn't work, try again.

She has no income, so she has no earnings to offset.

A child reduces your tax burden, it does not mean the government gives you money out of thin air.
