Hi, please see previous question.
To keep it short, I have been asked to pay back an overpayment when we were within the £2,500 threshold. I have disputed and got nowhere, i am now divorced and my new partner wants me to move in with him.

I am concerned that tax credits will take his wage into account and make me pay this 'overpayment' back. When it has nothing to do with him.
I will loose my current benefits so I will be living in his house and him paying for me and my daughter. All I will be bringing into the house money wise will be child benefit and the CSA money.

I will NEVER EVER apply for tax credits again, its just a loan but without you realising it.

Please advise, I'm really fed up with this stupid system!!!

i am going through exactly the same thing at the moment, me and my ex owe 2,500 and its in deault at moment i will have to go to court. however i have evidence to back myself so im going to try and fight this every step of the way, they are load of ****

the CTC works on the previous full tax year, in this case 05-april 06
So your partners income wont be used to calculate an credits woed to you.
Unfortuantely; if you owe them money they can and will take your partners income into consideration. This would be the same with any loan that you said you could not pay.
I would explain that you have very little money and that you want to make a payment plan.
Also, make a claim as the system can work well. And if you are still due money then this will help to offset any you owe

I'm afraid you've entered a nightmare world. It used to be quite simple but now it's almost impossible to understand. for three years running we were told that we had been overpaid despite
paying back the previous overpayments and our circumstances not changing.We even got Margaret Becket involved which sorted it out, but then it started again.We too are thinking of not
claiming, it just seems almost not worth it. I wish you all the best,

There has been a major **** up with tax credits my friend had to pay £3ooo back.My work collegue had to pay £2000 back.They issue the amounts and tell you that is your entitlement for that year then realise their errors and ask for it back,which im afraid does have to be paid back.I think they are looking to revise the system as it has proved to have been like this for millions of people.

I sympathise I had to pay back £1000, appealed, lost, they said I hadn't informed them soon enough of a change in circumstances. I told them as soon I as knew, I'm not a clairvoyant.

They are a law to themselves, I paid up to get shot of them. Never again. Good luck.
