We are being evicted on Monday for not paying our December rent, when we have concrete proof that we paid it. I am so angry at the pastor of the church that owns the house as it is her sole decision to evict or not, and she is choosing to believe a corrupt rental company instead of 5 people she knows very well. I am pregnant and my husband and I have 2 young girls at home, that she told me on the phone this afternoon, will be expected to be out of the house on Monday by 12, which means on the streets. I hung up on her before I said something I regretted, now I wish I had said it. How can I get some of this anger off of my chest productively so that on Monday I can approach her and give her a piece of my mind without freaking out and flying off the handle?

the concrete proof is receipts and bank statements, they have gone thru the court and have been rejected...thanks though for your input , but you didn;t really answer.

and yes they are planning to sell the property, this has happened to 3 other tenants of their homes in the past year.

This is a legal problem for you. Based on the expected tension between a landlord and a tenant being evicted, you should never be alone with just her anyway without several witnesses to verify your words or actions. If you think the pastor is involved in lying to cover for this eviction, what makes you think that she wouldn't lie about you threatening her or even attacking her. Don't be stupid like a Jerry Springer redneck and get the law called out on you just because you want to get even with someone. It's not worth it and that's a sure fire way to turn a bad situation into an even worse one. Write down your feelings and frustrations and plan on sending it to her after this is finished. In the end, you may not decide to send it anyway, but at least you will have an outlet until then.

Apparently, what appears to be concrete evidence to you didn't impress the court too much. Was the receipt not signed by the rental company?

Regardless, you need to contact a lawyer on Monday morning and determine how to fight this if its not too late. Maybe he can at least get a delay before you are evicted.

Take the high road. Maybe this pastor can help you find alternative housing. Kill him with kindness!!! Flipping out won't help your situation. You're under enough stress as it is.

If you have proof you paid the rent, you will need to go to court and prove it. They can't evict you without a court procedding. They can serve you with a notice of eviction, but then you need to go to court. The judge typically gives you 2 to 3 months to find a new apartment and move, etc.

That's where you'd bring your proof. The landlord can't just evict you for no reason. Not paying one month's rent(or paying it late) is not sufficent reason, especially if you've never had any other problems.

If they have served you or do serve you, contact the court system in your local area. Maybe they have a landlord/tenant dispute hotline where you could call for some answers. Usually this is something that is free. In my area, it is young lawyers working to get experience.

I had to evict someone years ago, and it is not a pleasant or quick experience. Know your rights. If this person is trying to bully you, stand up and go to court. If nothing else, it will buy you some time.

Tell her that you aren't going to budge an inch until you have spoke with a lawyer about it because you do have proof that the rent was paid. And then don't start packing just yet. Go to a good lawyer and ask them what your legal rights are in this case. They can't evict you before things are settled in court. With proof, I can't see a judge in all the land who would evict you and your family. Just mention the word "lawyer" and I bet they miraculously find the rent receipt and everything is ok. Funny how things like that happen. I hope that things get straightened out.

Yeah I agree if you have a lease and "concrete proof" it is against the law to proceed with an eviction. ALSO - in EVERY STATE you have 90 days to appeal an eviction notice and you do not have to leave your place of residence. You should educate yourself about Landlord Tenant laws I own 8 buildings in NY and have to go thru hell and high water to evict tenants that are not paying rent and dont have "concrete" proof.

By law, you can not be evicted without a court order, so she an say what she wants about having to be out by Monday. Unless there is an eviction order from a court, you do not have to move.

When they file the eviction, take the proof of payment to court!

WOW, This sounds like time to look for a attorney. This screams LAWSUIT!!!! A good lawyer will jump at the opportunity to sue your pastor/property management company. You said it, you have the key to make it all work "PROOF" No smart lawyer will turn down proof. Just remember this is a fight, you took the first shot, now it's time to hit back. It will be used against you that you dealing with a "Pastor" a "good person" ya right. DON'T YOU DARE LET THAT HOLD YOU BACK. Also don't say a word to her. Just get a lawyer, have them send your PM company, and pastor a lawsuit letter. Then watch them squirm.

Please listen to me. This same thing happened to me on December 4th of this past year. They CANNOT make you leave without taking it to court first. They absolutely CANNOT make you leave. DON'T LEAVE THE HOUSE! Since you have proof that you paid your rent, when it comes time for your court hearing.....show the judge. The judge will throw the eviction out due to lack of reasoning. Maybe they will be penalized for trying to do that to you given your current pregnancy state and the time of year it is. I would also look up information through your communities Community Action group. They may be able to end this before it even really starts. I wish you the best of luck. i say pray and tell god your problem cause by you cussing , screaming and yelling and whatever at the pastor who owns the house is no way to let go of your anger. you would be coming against the annointing on a women or even a man of god. if you do that god will get you and you could get sick in your body or get into a car accident, or possibly something else bad could happen to you or even your family. why stir up more trouble? or even the anger of god? then when the time comes around monday or before you will know how to talk to the pastor and you wont have all that anger out on the pastor that way. ps even god got angry sister but he never did sin when he [god] got angry. so pray and ask god to give you the words to speak to this pastor without any anger and god will help you with the words before you speak ok ill be praying for you and your family ok be encouraged

Don't give her a piece of your mind. It is a waste of time and energy. "Let go, let God (take care of her). Go to an Elder or deacon in the church and see if they can talk some sense into her. I am assuming that you do not have a rental receipt, cashed check, or money order stubb that can be traced to show who cashed it.

Otherwise, it sounds as though she may be using this as an opportunity to get you and your family out of the house. See if someone else in the congregation has somewhere you can stay for awhile until you find a permanent place, and you might want to also look into finding a new church and pastor.

There is probably nothing you can say that the other families she had evicted haven't said. You can inform your daughters youth minister you will be withdrawing her and why, although this is kind of petty and gossipy. Make sure you get your eviction in writing and contact what ever the equivalent to the tenants advice bureau is. They may not be able to help YOU, but it may help them put a stronger case together for next time.
