When you apply for marriage license both of your names are checked to make sure that neither of you are still legally married to someone else. Also after you're married the minister or whoever you have marry you will send in the paper to the state so that there is a legal record of you two being married.

Just like a deed, a marriage license is a legal document. Besides, it does add a little permanency (hopefully) when you have to sign your name.

to be legally married, you have to get one. it's not hard. you just go to the courthouse, fill out a short form with both info and have it notorized.
