Since "local district court" is an entity, and not a process, I would use "in".

In order to use "through" I would change the sentence to read: "If the Parties cannot settle the disput through negotiations, it is agreed that the parties shall settle it through litigation in the local district court."

Both are usable; there is no problem if you repeat "through" because in such constructions (when you say "not so... but so) it helps to emphasize what you are saying.

You can use either but I would use "in" because you used "through" earlier in the same sentance.
