Hello,
Election Commission cannot disqualify any person just because he/she is a criminal or he/she is having a criminal record --because India is a Democratic Country.
Everyone here in India has equal rights. So if a former leader or a new candidate (both with a clean record) can stand in election then why cannot a candidate with a criminal record?
Can anyone tell confidently that a candidate with a past criminal record will not fulfill the demands of the ordinary people?
And also what is the guarantee that a candidate with a clean past record will fulfill the demands of the ordinary people?
How many of the current leaders have improved the hard conditions of current problems faced by the ordinary people? Only a number of leaders that can be counted on fingers are there in politics which can be trusted.

If the election commission starts to disqualify the corrupt and criminal candidates who would be left to stand for elections ???!! Politicians today have given such a poor opinion of the way our country is run by them that not many educated sincere people like to get into this field. Even if they did would they be able to survive in that jungle there ?!! All said and done but they should be disqualified and certain qualifications set down for the candidates.

Election commission has all powers to disqualify corrupt and criminal candidates. That is why before accepting the nominations the candidates are asked to submit these details by EC.
U may all aware the recent judgement that corrupt MPs of 11 had been disqualified by Supreme Court by its landmark judgement

election commission will never disqualify corrupt & criminal candidates because in a democracy the people have the power to disqualify them. People will not elect them if they have a criminal or corrupt background. So the commission leaves the decision on the people.

The officials of the election commission or any other department or a premier institution for that matter is appointed by the Government directly or indirectly by the orders of the President of India.
And they are functioning at the mercy of the Government,eventhough they are vested with powers to function independently ,reporting directly to the President of India.
Nowadays, no party is able to get absolute majority and coalition Government has become the order of the day.
If the election commission is empowered to disqualify the corrupt and criminal candidates of a coalition partner, it may result in the concerned party withdrawing support for the Goverment ,and resulting in callapse of the Goverment.
So long as a single party majority government can not come to power, the hazards of coalition governments can not be eliminated.
Then, the responsibility is shifted to the public to empower a single party to come to power with absolute majority under the leadership of a good samarittan to control and exercise power to the welfare of the country.
That means ,the public wareness is necessary to know about the credentials of the candidates they are voting for. Again, it is possible only if the literacy level of the people can be raised to 100%. To achieve this, basic education is to be imparted compulsarily to all the children upto high school level, so that when they get voting rights ,they will be able to think independently as to whom they should vote to elect candidates with out any criminal records.
We should the following.
1)Educate the public and in the long run they gain the knowledge to vote for the right candidates with out criminal records.
That is eliminating the scope of corrupt& criminal candidates at the sourc itself.
2)People should vote for any majority party so that , that party can excercise power with out any fear or favour in empowering election commission to disqualify corrupt and criminal candidates.
With the foregoing details, under the prevailing situations, the election commission will never disqualify corrupt and criminal candidates.

Election commission has a strict of rules.And in which it has no power to disqualify those candidates.
It is the job of the party leaders to disqualilfy the members who take part in corrupt and criminal candidates..
Beoyond that it is in the hands of the people to select as their leader

Election Commision cannot disqualify Corrupt &Criminal candidates because most of them have their cases being going on in the court of Law and everytime the candidates plead innocence till proven guilty.New laws are required that will disqualify a candidate if any case of investigation is pending against him till he is acquitted from the court.In a poor Country like India People are likely to vote for goodies for living than good governance .A very good reason to eliminate poverty from our Nation.
When the law makers are themselves law breakers and equate themselves with Gandhi and other freedom fighters when convicted and sent to jail , how could they change the laws for disqualifying candidates.
Politicians also need a lot of money and muscle power for a seat in the corridors of power.So even the most honest politician or minister has to approve or ignore the history of the selected candidates.

Indian politics is very strong in manupulation. Our parliament is full of criminals and corrupt. We can count from fingertips the good non corrupt and no criminal politicians. During the election if he disqualifies the criminals, who will fight the election then. If election is contested by other innocent people the criminals will not leave him/her to survive.
Soas a election commissioner, he need to do his duty to hold election. To maintain that he can not disqualfy the candidate, if he disqualify there is no contestant and no eletion and no position for the commission. At the end he need to salary to survive
