If I have 3 kids, and the earned income credit is for 1 or 2 or more, can my ex husband (with my permission) get the earned income credit off of him even though he does not live with his dad?

What i'm asking is since i max out on the other two children, can I let him claim the 3rd?

If he pays child support or has them for 6 months out the year.

If he provides child support for that child then probably yes. Many divorced couples share the kids on the income tax forms. It is legal as long as nobody is counting the same kid twice! Call up the IRS and ask them--they are remarkably friendly. Sometimes the rules are a little crazy when it comes to EIC so make sure you call them and ask.

I have done our taxes for years and have called the IRS with questions almost yearly. I only had something approaching rudeness once. I had been counting my husband's G.I. bill against EIC and the person almost had a fit saying that the federal government had nothing to do with my husband's G.I. bill benefits and I was absolutely not to add it to my gross income when figuring out what we got for EIC!

My opinion is you can claim the "earned income credit" for up to two kids, period. I do not recall that the credit is available on more than two dependents. I'm not a tax guy, but I do my own taxes every year.

I don't see where there's an additional credit available, so your question regarding your "X" is mute.

He should be able to but you won't get the deduction for the child.
