on a w2, can you an employee elect do pay in $0.00 all year, but have the employer collect solely for fica and ss?
been with the same company for 3 years, i filled out a w4 when i first started. i just recived my w2 today, and it has federal blank, but fica and social security paid in.
looked at both '04 and '05, and i had paid in.
somehow, no clue how, but on my '06, this box is blank, i looked thru paystubs from 04-05, and fed wt is listed on the pay stub, but it is not listed at all on '06.
of course i want to know how this happened, but can the legally submit $0.00 thru out the year. i filed for them to take it out, really, whats going on here?
i understand i am solely financially liable, but is there anything i can do other than have them change the way its filed. have i any recouse? or something??!

Sounds like they made an error in entering your withholding choices. I'm sure all withholdings are done through software, so no one would have been looking at it to catch the error. They would certainly say you should have paid more attention to your paystubs.

Yes, it is legal for your employer to not withhold taxes.

I suggest you go speak with payroll to make sure that these taxes really were not withheld and that the W-2 and your paystubs are just not showing it. Then, they can work out your withholding issue. Basically, it is up to you tp report an error, but since you filled out a W-4 and they didn't honor it, that could be a legal issue. However, since I'm sure it was just an error, you wouldn't get anywhere by reporting it.

FICA (Federal Insurance Contributions Act) IS Social Security. I would check with the human resources person for your company.

New laws mandate that an employee pays at least 80% of their federal withholding tax before the end of the year, or be charged a penalty.

I would file a new W4 form with the company (make a copy for yourself) so they do not make the same mistake this year.

You can always call the IRS with this question for a definitive answer.

It could just be a glitch in the accounting software. You need to call your employer and ask.

Are the federal payments showing on your pay stubs? If so, you have proof that it's been paid in.

Edit: I just re-read your question and saw that you said they're not showing on your 06 pay stubs. You need to find out right away from your employer what went on and whether they took the federal out of your pay or not.

If they really did not take out the federal, then you'll need to talk to a tax preparer about what needs to happen next.

Withholding is based on the information from the W-4 that you turn in the first of each tax year to your employer. If the number you put down to deduct for so determined that you had no FIT withheld then none was withheld. Make sure you fill out your W-4 correctly.
