I was officially divorsed in January of 2006. I filled as single last year because I had been seperated for six months and thats what the tax office told my ex that if we were seperated we could file single. Anyway. I moved in with my new BF (now fiance) in April of 2006 and we had a baby in September. I am claiming our daughter, MY QUESTION IS.... can I file as Head of Household since my Fiance and I are not married or will I just have to file as single.

By the way, just in case there was a misunderstanding, my daughter is my fiance's child, not my ex- husbands.....

If you paid more than half of the cost of maintaining a home for you and your daughter you can claim HOH if you are claiming your daughter as a dependent. If your BF is on the birth certificate as the father he could do the same if he paid more than half of the cost of maintaining the home. Both of you can't claim HOH because both of you could not have paid more than half of maintaining the same home nor could you both claim your daughter as as dependent. The one of you with the highest AGI (makes the most money) should claim HOH and the other single.

I would ask a tax office like h&r block.However see if you will get more back if he files head of household and claims all the kids.When me and my ex split I still let him claim us.We split the money.

when i filed i went to www.expresstaxrefund.com and they had a section to claim dependents. when i had a question i just called the free customer support phone line and they answered my question as soon as I asked it, the support team there is great.
i would suggest doing that, you don't even need to file with them to call the support line, but the site was great and easy to file with.
