I am on probation in Texas for Possession of a controlled substance. I am worried that I will have my probation revoked because I am behind in my community service hours by about a month. I also have not attended my drug classes as regularly as I should. I am caught up with my financial responsibilities and I have never failed a drug test (I've taken 5 in the last 8 months). My probation officer is a real ball breaker. If I do get a motion to revoke, will my probation officer arrest me on site?

He can not have you arrested on sight by a police officer. He has to get the prosecutor to file a motion to revoke probation. All probation officers are difficult. It's their job. Missing your drug classes is a big deal. Fix it immediately! Being behind on your community service is not as bad, but when you put the 2 togeather, it looks like you're ignoring the Court. You have to fix this right away. No matter how tough probation is, it's a lot better than a Texas jail. Your probation officer does NOT want you to fail. That means he/she has to go to court and testify and they are too busy with appointments every hour of the day and lots of paperwork. They're skeptical because they hear a lot of b.s. You still have time to fix this. DO IT!

Your only hope is either your probation officer or a lawyer. Those are the only two people who can make excuses on your behalf to a judge.

Either have a good excuse, or be prepared for the arrest warrant to be issued bringing you back to jail/court, and from there, it could go either way.

I suggest being Mr. Niceguy about everything, stating your progress and willing to do more. Probation is to keep the jails from overflowing, but they will make room for you if you push it too far.

Catch up on your community service if you can. If you have a tough PO they can get your probation revoked. Most of the time they will try to work with you. I would talk to him and try to make arrangements. If not he can have you arrested on the spot!!! Good Luck!!!!
