i would like to know more about it

My sons father is in the military and hes suppose to pay child support
i also went to court today but i didnt really understand all of it and i just want to know the law and what it states

here you go. military law is known as the uniform code of military justice. it was instituted during the revolutionary war june 30 1775 by the second continental congress. when theynpassed 69 articles of war, it was later officially ratified as the UCMJ by congrss on may 5 1950

oops I almost missed the reason for your question. I highly reccomend you speak with an attourney first. they have a solid understanding of the law and can help you out their.

then you well want to speak with the JAG corp. AKA the Judge Advocates Generals office. the JAG corpmis not just a pretty tv show. it is the militaries over arcing legal arbiters. they enforce the UCMJ, and arriange for court martial proceeding and other such items of law.

It is the JAG corp that can tell you wether or not this case fall sunder military jurisdiction or not.

but first and most important is for you to hire a lawyer as soon as possible so that you can understand your rights.

I'd start with the Uniform Code of Military Justice and Manual for Courts Martial. These are the two basic "bibles" of military law in the US. Military personnel are also subject to nearly all Federal, state and municipal laws.There are a few exceptions but child support is not one of them. A valid child support order will start the process. The DOD is not too keen on members not supporting their dependants.

In the UCMJ. He has to pay the support as per the court order. Weather he is in the military or not is irrelevant. If he does not pay it you can have him arrested and he will have to suffer the consequences of the military for not being where he is obligated to be. .... He will have a bad day X many days if that happens.

You could google The Uniform Code of Military Justice.

You can also contact his superiors if you can supply his Name Rank and Service Number. There may be help available to you from his Branch of Service.

You will need copies of any legal papers pertaining to paternity, divorce, settlements, and judgements.

You need a lawyer, start by contacting your Father's Branch of Service.

If your father has a legal obligation to pay, then his service is obligated to see that he does.

This is your right under Military Law, they will deduct this from his pay if he fails to meet his legal obligation. There will be damage to his career if you go forward with this.

The threat might be enough to get him on the right path.

YOU CAN GET ON LINE AND LOOK UP US MILITARY OR U CAN GO TO A MILITARY RECURTOR AND TELL THEM WHAT U NEED TO FIND. U WOULD THINK THEY WOULD NOT TELL U BUT THE MILITARY IS VERY HARD ON THEIR BOYS IF THEY NO THEY ARE NOT TAKING CARE OF THEIR KIDS AND THEY ARE BY COURT ORDER TO DO SO. Call the post operator, family support group and have them give you the JAG number.

UCMJ is military law, they can explain it to you as well.
