A co-worker and a low level supervisor spit in a customer's coffee cup. I told the manager but she is not going to discipline the co-worker. I find the mere act disgusting, and with today's health concerns, even consider it assult. Should I take this furhter. Report it to the District Manager? I already told the co-worker I thought it was disgusting.

First, even though you may consider it assault, it is not as the person who drank the coffee was never aware of any potential harm (which is a required element of assault). Second, and more to the point of your question, I do not think you should report it to the District Manager. As you already reported it to your manager, and your manager used their judgment not to take any disciplinary action, you risk your job if you go over your manager's head. They will know who generated the complaint and may make your workplace environment less pleasurable (although with co-workers spitting in coffee, maybe the environment is not so good anyway). I say let it go, you've already noted your disgust with the manager and the offender - it's not as if you stood by silently.

Often there are two sides to a story; had this customer been *truly* nasty to them perhaps (not just a bit rude or absentminded)? It's still a childish way to get back at someone, but at least if they only did it to someone who totally cussed them out, you could think of it as a one-time incident, and it'd probably not be worth to risk your job over it.

But if it's their idea of entertainment, then it's even more wrong & if your manager can't see that, I'd definitely talk to the District Manager or the Health Department! I wouldn't want to keep working in the kind of place where that sort of behaviour is considered acceptable, so it'd be an acceptable risk to take if you were to be fired or had to leave instead of that coworker & supervisor....

Find a new job and in your letter of resignation tell them the reason you are leaving is the behavior of the low-level supervisor, co-worker and the manager who refuses to do anything about it. Then, send copies to all those mentioned and the bosses' boss. It is possible that the manager isn't going to do anything because it can't be proven but you don't have to work there.

Are you willing to lose your job for taking a stand for what you think is the right thing to do? If the answer is yes, speak up and tell the big boss. If not, better fall back into the background.... What does your heart tell you to do? I say be a tattle-tell and if you lose your job....you can live with the fact that you did the right thing! I sure wish I knew the place your talking about.... So I can stay away!!

Yes. If they've done it to one, they've done it to others and will do it again. Especially if they aren't disciplined now. Write an anonymous letter to the District Manager and explain the situation. No self-respecting business person is going to allow that type of behavior from their employees.

I would call the district manager - but if they do not act on this - call the Health Department. That is considered an assault and totally illegal.

Report it, its disgusting and down right nasty what if that person who spit in the cup had some disease and passed it on to to the customer it is absolutely wrong.

What a shame that your supervisor chose to let that go. It is totally unacceptable. I say take it to the top. Good for you for standing up for what you know is right. If that employee has permission to spit in people's cups, what is next? Yuck!

It is totally gross and I can see why you'd want to take it further. I think that if your manager's not going to do anything then you too should leave it be. They're only going to deny it and it's your word against theirs... I know it'll be tough to ignore, but I reckon let it be - else you could come off as the bad guy with sour grapes... Good luck :)

I agree with hairdvs that you should start looking for a new place to work. And I also agree that you should report it to the Health Department.
