You can claim her if she was born at 11:59:59 on December 31, 2006.

Yes, unless you are divorced and in the custody agreement it is prohibited. My husband and I are divorced and I am allowed to carry both of our children on my taxes.

Yes you can as long as she meets the other tests for being a dependent.
