Very interesting question.....personally I would do the following.....
Get in the horses face and tell him that if he doesnt talk like Mr. Ed and apologize ASAP that you are going to turn him into glue.....I would also threaten him with Iron prods and tire irons. Beat the living hell out of it. If that doesnt work, just send your girlfriend there for an hour or 2 and have her talk to him. Most animals would rather you kill them or any of the above than listen to a female talk. Hope that helps!

4 month olds don't walk...so I have a hard time believing this. But if your friend punched the horse just because he stepped in some manure, I would have to be a cold hearted person and say yes, its your friends fault that his nephew died. He should have expected to step in something when he went to the stables, (Come on its a horse stable - of course you are going to step into something) And its washable, he had no right taking out his anger on a horse for doing something that comes naturally to him. Next, if the horse kicked the 4 month old wonder walking kid, the mom or your friend would have had plenty of time to get to him before he suffocated. It would be more believable if the baby died because of injuries caused by being kicked by the horse. Tell your friend it is his fault and he needs to take some anger management classes.

I feel really bad for her. No its not her fault. Some horses are unpridictable. She should have kept an eye on her son. The horse was't used to seeing little children especially an infant around the horse. My calf Nikki didn't like any tiny or little kids. She was deathly afraid of them. I tried everything in my power but no use. I guess it depends on the personality of the horse.

Hmmm.............
In the real world, your friend would be at fault for being cruel to an animal.
However, in the jokes and riddles world, I would say the negligence lays with the horse manure for suffocating the young boy.

Though this is in the "Jokes & Riddles" section, I'm gonna take it seriously. I would say it's your friend's fault. He should know to not walk behind a horse, and especially should know not to punch it in the poop-chute.

Isnt this the Jokes and Riddles section in Yahoo! Answers, because that is kinda funny, except the friends dying. But I would say it was his fault.

No. The horse was defending himself/herself. Sorry there's nothing you can do!
