i have a 4 yrs. old step-daughter and we have no coustody. her mother has full coustody but we have not seen or heard from her in 3 weeks. we can't even take the little girl to the doctor.for a check-up or anythingshe needs to be in pre-school but her mother pulled her out be cause she had headlise. we have a case worker with family services but they say that it isn't abandenment because she is with her father. i have run out of ideas every one says get a lawyer and fight it but we can't afford that. we are paying her mother $55 a week to take care of her and we have her. that doesn't make since to me. we have heard through friends that she is useing the money for acohol but the courts won't make her prove what she is spending it on because we are a little behind on it. i'm looking for anything that could help our case any.
please help

If your fiance has a cause number through which he pays child support, he can go to the court he was ordered through and file a petition for emergency custody. He also needs to ask the judge to hold the money in trust until the hearing. What happens with that is that he still pays the child support, but the clerk in his county doesn't send the payments out to anyone. They hold it until the hearing and according to the judges ruling, they release it to either the mother or father. Your fiance being behind on his support won't have any effect on this money being held in trust. Do you have the child on any assistance such as medicaid or tanif (welfare check) in your fiances name? If so your county child support office is obligated to get an order for mom to pay to dad and they may be able to point you in the right direction. Another thing to look into is to see if your county has a legal aide department to help assist people who can not afford an attorney. Good luck!

While it may not be abandonment, there is still something you can do.

1st - get the social worker to document - how long you have had the child. Do this every time you are left with the child. If you have had her for 3 weeks, - why should the court force you to pay child support?

2nd - ask the social worker to direct you to a free legal service clinic. If they will not (may not be allowed), then go thru your phone book. If you still cannot find one, go to a church and ask them to help you find a lawyer /legal clinic to help.

The main issue - which you have not commented on - is: If the Mother is unfit, do you and your husband want full custody or to see the little girl in a good home?

Call a referral service and find an attorney that will take payments! Or read up on how to do it yourself. There are places you can buy the papers to request the court to look at this. Talk to the people at the court house, they were very help full to me. Explain your situation and find out what papers you need to be filed to get shared custody and child support changed. Then you pay a small fee and file the papers yourself. You can also talk to an attorney free for the first consultation, see how much he will charge to help you fill the paperwork out and what you need to do to do it yourself. Good Luck!

pending on what state/county you live in, her father can always go back to court to amend the custody agreement. She will have to show up etc. etc. and prove why she should have full custody. You do not necessarily need a lawyer for that, often it is just a lot of paper work and the court will assign a guardian and a metiator.

this is situation need to be handled b4 the mom starts asking 4 more money, u need to sue her get someone u know but someone the mother doesn't know and have them follow her around, if she does go out to by beer, u can diffinitely use this against her still.... call authorities also and ask them what they think of the situation... hope this helps u out a lil bit :o)

You need to petition the courts for full custody. You have a birth certificate for the child with the father's name on it? Does he have ID? Then you can enroll her in preschool. They don't ask who has custody. They just want to get paid.

sounds like you have harassed the child's mother so much that she has given up fighting with you. hope you are happy with yourselves.
maybe you should all think of the child rather than yourselves.

Courts hate men, so sorry man but as long as you have a Wang they deem you unfit to take care of children. I hate it. Sorry man.
