that my mother in law can file and me my husband and child on it and get money back from my child on it ... but when my husband files we can't i don't understand

It appears from your description that you have no taxable income. If your mother-in-law qualifies to claim you and the children then she can do that.

If she provides a home for you and your spouse, then it is possible that even with your payments, she pays over half the cost of your support. In that case, she can claim you and your spouse as dependents.

She may receive payment from the government, called the Earned Income Credit, for providing a home for the children. The payments you receive for the children do not disqualify her from claiming this credit.

If you have any earned income (wages from a job), then you could file and claim the children and get an Earned Income Credit payment, but that doesn't appear to be the case from your question.
