I remember specifically not wanting a Discover card in college and never filled out an application for one. I also remember the vendor signing people up for both Mastercard and Discover. I signed up for a Mastercard only but ended up receiving both cards later in the mail, with my name misspelled on the Discover card. I used the card and even made payments but realize the card was issued to me on fraudulent terms.

You received it, didn't cancel it or send it back, used it and made payments on it...yes you will be held liable for the charges.

On the otherhand, the guy that signed you up for Discover committed a felony. Whether it is concidered identity theft or identity fraud he committed a federal felony. You still may have recourse against the guy that did it, but it probably will just end up costing him his job and won't get you any renumeration or erase any charges on the card.

Yes, you admitted that you use the card whether they spelled your name correctly or not.
