CONUS is continental United States, in case anyone is wondering. Its for a hearing for failure to pay child support. I'm assuming the military would decide on letting him go based on the needs of the mission, just asking in general what may happen is this kind of situation.

Should have clarified this, its not me, its my girlfriend's ex-husband that's in the service and will be served to appear. He's in Guantanamo Bay, Cuba.

If he is deployed he can request that legal proceedings be delayed until after he comes back under the Soldier's and Sailors Relief Act.

BTW - the Army uses a formula to calculate fair child-support payments. If they feel that a court has ordered excessive amounts then they can tell the court to go pound sand.

is this a trick question or are you looking for homework answers? based on the information you have provided I conclude the answer is yes. if you are working at your job and you are required to go to court you must appear. So if you are properly served, outside CONUS and it concerns child support and i since it awfully cold in Alaska where it is better to cuddle than be divorced i conclude you are in Hawaii. go to court and pull night duty.

Hey! Your BAS is intended for support of your family. Pay up.

A check with JAG may just get you into trouble. If you are being deployed, send a copy of your orders along with your summons to the court

Talk to a JAG and see if he can send the necessary paperwork to the court to get an extension, or you can write the court yourself and do the same thing.

it will be held for continuance until he gets back. no legal proceedings may be established while a servicemember is deployed or OCONUS unless they themselves file the paperwork.

he will go before a judge in guba and be made to pay just like any other out of state case
