If the father hasn't done anything to legally establish his rights and doesn't have any court ordered visitation or anything like that then, yes, she can legally move.

YES and NO, The unmarried mother has more rights then the father unless he pursue more rights legally through juvenile court. Without a grant of custody from the court, the father has no say so and the mother is free to move.

Depends....were they married when the child was born..if so, the divorce decree should state whether or not she can move. Is dad's name on the birth certificate? Is there court ordered support and visitation guidelines? Unless there is something in writing from the court that says she can not move...she can do anything she wants to. If the father doesn't want her to be able to leave the state with the child, he needs to petition the court. At least, this is how it works in Indiana. My divorce decree states that I cannot move my child more than 100 miles from the county in which we currently reside, without permission from the court.

yes, she can move if the father has not filed any kind of custody. sometimes it can be written into the papers that both parents must live within a certain distance. even if that is included they can still move but the child can only visit during the summer or something. if there is no written papers that say they have to live within any certain distance then either parent can move ANYWHERE including to another country.

yes she can. if there is no court order saying other wise she can go any where she wants to and take the child with her. so if this is a concern for you, you can go to the family court in your area explain to them what her plans on and ask them to place a temp. order that she not be allowed to take the child out of the area. then you will have to take her to court and let them decide. more than likely they will say she has the child for this many months if she lives in another state and you have the child this many months.good luck.

not if you have a court order saying that you have joint custody and must spend every other week or every other day with the child- without a court order for visitation rights, there is nothing you can do
