I am going spare! I was rearended, the other car's insurance accepted responsiblity. But the adjuster has been rude on the phone. I keep having to phone to get the car rental amount for extra days - the adjuster said the car needs further work, so an extra ten days rental. I decided to take a daily cash amount instead of a car rental. But the insurer keeps trying to stop paying, even though the car is not fixed yet. The insurance adjuster sent me something in writing saying the car would take another ten days. Then I got a phone message saying "yes, we'll pay a few more days, up to the ten" - and then literally two minutes later "sorry - we've payed enough, we won't pay after all". It is driving me nuts! I think the insurance should pay at least for the days they said the car would be in the repair shop - in fact it's now been in for longer than that, but that's even harder to get them to pay rental for...Any suggestions how to handle this? I don't like phoning this adjuster.

Thanks for answers! I did try to file the claim with my own insurer, but because I didn't have collision insurance (I thought I didn't need it as I've never crashed and my car wasn't worth too much anyway) my insurer said they would just 'report' the claim to the other party's insurer. So they haven't been claiming on my behalf - I've had to do this all directly. It is quite difficult - I feel that the adjuster is trying to catch me out all the time, as I've never had to do anything like this before.

You need to find out why they are not paying. Is it taking longer to repair because the body shop made a mistake and needs to fix it? Because then the insurance company is not responsible for that. You said the adjuster said the car needs extra work - get a copy of the supplemental estimate showing the extra work and number of extra days. Maybe the insurance company has reached the maximum amount that they can pay monetarily for your claim because of the other person's property damage limits and can't pay anything else. This happens a lot.

Unfortunately, the only way to know is to call and ask, whether you like the person or not.

Hmmm.... did you choose the shop of your choice as opposed to a network (meaning one of their) shops?

If the shop of your choice takes an unreasonable amount of time the adjuster has every right to cut off rental... lets say you took it too "uncle ricos body shop" and uncle rico has no idea what hes doing and is taking months... why should insurance be responsible for that?

But on the other hand.. it sucks you have a rude adjuster and that they are being wishy washy- they should be more firm with their decisions and decide either way.

Id calmly call one more time and ask why the rental is being cut off. If the adjuster makes your uncomfortable.. calmly ask for the supervisors number

Contact the other company and ask for the adjuster supervisor. sometimes talking with someone else will help. The supervisor may be able to explain to you what is going on with the claim.

You should always file the claim with your own insurance company. They will then settle with the other driver's insurance company. This will save you loads of aggro in the long run. If the other driver is at fault and your insurance company recovers from his, your NCB will normally be protected.
