She bent over to pick something up, he was facing the other way, she came up quickly while his arm was coming down. POW! Right in the kisser. Cracked tooth = damages at $5000 (she wants an implant). They are lovers out of convenience, with no plans for a future together, in fact, relationship was about to end. She wants him to look into having his homeowner's insurance cover it. What is the right thing to do?

Would it change anyone's opinion to know that he is financially secure, and she is up to her neck in student loans?

Well, it would be a nice gesture on his part considering their financial situations. On the other hand, his rates will go up and it seems like a dental insurance situation - at least that's what his home owner's agency will argue.

If she has medical/dental, why isn't she using it? Isn't that what its for? If not, well, I don't see why he should be required or compelled shoulder the entire thing if anything - it was an accident that she was just as much a part of.

$5000.00? No way is an insurance company - home, dental, medical or any other going to accept that payout. They will maybe cover the minimum to fix the problem - and in this case they would be right to fight it.

That's like - hey, you put a minor dig in my car door in the parking lot - I want a new car. WTF?

No. It was an accident and she is responsible for the damages. If he had done it on purpose or had a way to avoid it happening, then maybe he would be responsible for it, but not in this situation. He should not look into the insurance because his rates could increase if they pay it, and it will still count as an "incident" even if they don't pay. Getting an inquiry for what is covered still goes into the file and is considered when applying for future coverage. He could get cancelled.

$5000 for an implant is REALLLLY high. If it turns out to cost anything close to that, the couple should fly to Costa Rica, have a nice three week vacation while she has her implant done.

HUH!

An implant in Costa Rica will cost about $1000, airfare = $1200 for two, that leaves $2800 for lodging and PARRRTYYY!

thats not true, i've seen people sue for it before; dental and plastic surgery for the lip.

implant, they probably wont pay for it. they would be willing to pay for the root canal ($900) and a cap ($400). the homeowners insurance goes up and thats that.

i'd love to know the outcome. curious as to if it (another win for dental) happens elsewhere (im in NJ).

It sounds like she is Jewish. If the situation happened in your house, then it will be covered with homeowners ins. There is no way an injury like you mentioned will be 5000.00. A woman like that, with her mother of course,steer clear. I would get a lawyer ..they will try to screw you.

It was an accident which means no party was at fault. Unfortunatley SHE has to pay for it all herself. Go to a local dental school (college) clinic if you want it to cost less.

I don't see how he could be blamed. Maybe a bridge would be cheaper than an implant.

$5000 seems quite expensive..
If his insurance will cover it then he should get it fixed for her.
If his insurance doesn't cover it , then he should still try to help
her get it fixed....
