my frield has greencard, he left U.S in March 2006 to China for his mom's funeral. Now he is planing to come back to U.S from China, but it has been more than 9 months he stayed out side U.S. I heard one with greencard can only stay out of U.S for less than 6 months, so is his greencard consider expired? and how can he come back now if the greencard is expired?

He can stay out of the country for a year provided that his residency card doesnt expire while he's out (if it does, he can file an extension at the nearest embassy). If it will not expire for some time, he doesnt have to worry.. he can come back for a period of one year. If he wants to stay outside of the u.s for more than a year, he needs to file a different kind of extension (embassy). This will let him stay out of the u.s for up to two years (no more than that). If after two years he still doesnt return, he can lose his residency because it is considered abandonment.

Plus, it is recommended that before leaving the u.s, he should get a re-entry permit from the immigration office.

green card is not expired, bu she must go to embassy and check does she need reentry-permit, because she was out of USA more than nine months
