I am assuming, since the children are receivng the payments, that this is Social Security disability. You will receive a Form SSA-1099 for these payments, one for each child.

The disability payments received by the children are their income. You do not include this income on your tax return.

The disability payments are not taxable income to the children either, except for the unusual case when the children have substantial income other than these payments.

The disability payments which are spent on behalf of the children are considered to be provided by the children for their own support.

Only if he gets a W2

Disability is taxable if the premium was paid with pretax dollars.
If the premium was paid with after-tax dollars, it's tax free.

The W-2 tells all, knows all.

I'm assuming your children are getting childsupport from their fathers disablility. If this is true, you don't have to claim child support, however if he was paying you alimony then you would have to claim it.
