I worked for this bad person for couple months. By definition, I was an employee, because he scheduled the jobs for me and provided places as well as assistants to me. However, when I received my pay check, I didn't find any deduction or money witheld. He told me that I was an independent contractor.

File a form SS-8 with the IRS.

You have to file as though self employed. This is becoming a very common problem, companies treating employees as independent contractors, then you are stuck with a large tax liability. I don't know how much you have earned, but if it is significant, you have to pay estimated taxes, the next and last installment is due 1/1/507. You can deduct mileage on your Schedule C, which a self employed person files. You must include this income as the person will send a form 1099 to the IRS, as well as a copy to you. You should talk with a tax pro, or with the IRS where they can see how much income you have.

You are stuck paying all the taxers, even the employer's share.

You are stuck in a situation that either you turn him into the IRS (See Form SS-8) (this is done anonymously, by the way, but I'm sure he'll figure out who did it) OR you get out of there. And then maybe turn him in.

It's not too different than an abusive spouse situation in that it is very hard to leave a job, but staying isn't worth it either. Both ways you get hurt.

But get out of there.
