I worked for this bad person for couple months. By definition, I was an employee, because he scheduled the jobs for me and provided places as well as assistants to me. However, when I received my pay check, I didn't find any deduction or money witheld. He told me that I was an independent contractor.

The rules for independent contractor - are very specific.

He's trying to get out of matching the FICA taxes that are due.

The IRS needs to be contacted immediately.

You must protect yourself - however you may not have that job long.

You have to file as though self employed. This is becoming a very common problem, companies treating employees as independent contractors, then you are stuck with a large tax liability. I don't know how much you have earned, but if it is significant, you have to pay estimated taxes, the next and last installment is due 1/1/507. You can deduct mileage on your Schedule C, which a self employed person files. You must include this income as the person will send a form 1099 to the IRS, as well as a copy to you. You should talk with a tax pro, or with the IRS where they can see how much income you have.

From your description, it's still very uncertain whether the IRS would have classified you as an employee rather than an independent contractor. It depends on how much he controlled HOW you did the jobs.

You could contact the IRS and ask for a determination of your status. In the meantime, if that's not complete by mid-April, you probably need to file your taxes as an independent contractor.
