CUT the guy a break.
Statistics state that quite a few members of the american population are 3 paychecks away from being homeless.
This could be you if you loose your job.
WOuld you really want someone to throw you out into the very cold street.
Dont make a huge issue of it until summer.
It would be compassionate of you to offer him some of your old clean clothing or a blanket. Maybe a can of soup (with the pull tab).
Who knows what his situation is...would you still feel the same way if he did not stink?
If so maybe you could locate a mens shelter in the area where he could go and catch a shower. Dont actually talk to him, just leave a note for him with the information on it and the instructions on how to get there. If you wanted to be really nice you could even throw in a few bucks for him to get a cup of coffee on the way.
Think about walking 20 feet in his shoes!
This man may feel like no one cares and it would brighten his world to know that someone does.
YOu will feel so good about yourself for doing this and you will solve your problem of the bad smell without denegrating this man more than he already has been!

I would say that yes, he's trespassing.
My recommendation (I'm sure you won't like it) is to invite him in for a shower. Next time you're out, stop at the Goodwill, and see if you can find a cheap outfit that looks like it will fit him (in my town, you can get stuff for 50 cents a pound, so it's not like it's a big investment). Let him swap outfits, and after the shower, he won't smell so bad. He'll also be much warmer, from the hot water, and may be more comfortable outside.

Since he won't leave ask him ,if he goes to a shelter and gets cleaned up you'll buy him lunch,just because he's a "bum" doesn't mean he's not human....They are a pain but it will not hurt to show some compassion.....It could be you in a couple years.
