is it possible to access one's records if you are not a blood relative? My boyfriend told me that I could call the jail he is currently locked up at and ask about his medical records, however, I believe that these are confidential and I would not be allowed any information in them. Am I correct or is he?

I wouldn't think anyone could access anyone else's jail records. Period. Unless you're law enforcement with a legitimate need to know.

There are only certain things that you will be able to find out from the jail, and that is all the stuff that is covered under public information.

Everything else, it should not matter whether you are blood relative or not, you should not have access to. Especially medical records there at the jail.

All medical records are subject to HIPPA. That;s why when you go to the doctor office these days, they ask you to sign something allowing them to view your records. You will never see them - not even if you were his wife.

I worked at a state's Dept of Corrections for 12 years. I managed a computer system that displayed reports that showed "codes" so the staff would know who needed medications, work abilities, special diet, etc. When HIPPA came out - we got into a BIG FIGHT - one side arguing that displaying these codes were considered as showing medical information. Therefore, the staff would have to stop using these reports to manage the inmates. But I finally found (in over 30 pages), a sentence that stated Department of Corrections, if using for operational purposes, was exempt from HIPPA. :=)

criminal & civil records are public knowledge and you can go to the courthouse and/or look them up or look online. To look online you need to look up the clerk of courts for whatever county the "event" happened in.

But......

Due to the HIPAA Privacy laws, NO ONE can gain any medical information about anyone else. You will never be able to find out any medical information about him, even if you are married. The only way you can is if he gives you written permission and I think that written permission has to be notorized.

As a mother, your question made me shiver. Your boyfriend is in jail and you are concerned about his medical records.

The fact your boyfriend is in jail is public record, if he is charged with a crime that is public record, any other evidenciary or personal information is NOT.
By calling the jail you can get his name, the charge, any bail, and his inmate number (if any) and jail mailing address. You will get no other information. If he has a court appointed attorney contact him.

The jail wouldn't give out that information to anyone. It would even be hard for a Doctor to get it.

I really wouldnt be too concerned with helping him in prison unless he is actually innocent, which is 1 in a million. I would be more concerned with leaving his sorry ***! There's a reason he's in jail and you shouldnt be caught up in it!

he has to sign a release form for you to get anything that is medical.jail records are public.
