Cory, never mind the morons here. The point is that you weren't hurt. As the owner of an 02 GLS Elantra with about the same amount of miles on it I can tell you that it's an expensive fix. Hopefully 1. The guy has insurance and 2. They WILL total your car, allowing you to get another one.
Unlike the above posters who obviously don't realize the VALUE AND SAFETY that comes with EVERY Hyundai...regardless of the price.
If they don't want to pay up, I'd be ready to sue. Companies and insurance companies need "incentive" to pay what they owe you.
Book value for your car in good condition is about 4500 dollars....but it's about more than that - make them replace your transportation. It is your right under the law to be fairly compensated.
If you feel inclined however, get the car repaired. It may save you on insurance...

The likely hood of your car being totaled is almost certain. Try
and get an idea on the value of your car from a website like
Kelly Blue Book, so you kind of know whats going on. From
what your describing it doesn't sound like the truck was going
fast, that's good for you, because had he you might not be here today. Anytime someone hits you in the rear end it's becomes
the persons fault by law. One last thing I would advise is since
you were rear ended, you should have yourself checked out.
It is possible that you could have an injury, and not know
about it, IE herniated disc or some other spinal injury. It's
your right, and you owe it to yourself. It has nothing to do
with who is suing who, and don't think of it like you're trying
to get over, the fact is if your are injured you deserve a settlement. Take of yourself, and good luck.

Yes, it is likely totaled. File with his insurance ASAP. They will look at the car, estimate the damage and do some calculations. They have an equation that tells them whether to total it or not.
BTW, go to nada.com and kbb.com before the adjuster gets there and get the FULL RETAIL values for your car. Don't accept anything less. You should also get a rental car for a few days, or until they get you a check, if it is longer.

since it is a hyandai, and they aren't worth more than say $5, it will probably be totaled. If the frame is bent, that would take a lot of work to correct.

Don't know, since I can't see it from here. Even if I could, I'm not an insurance adjuster. Your insurance will send an adjuster to look, and if the cost of repairs is greater than the worth of the vehicle, it will be totaled. They will pay you the vehicles worth at the time of the accident, adjusted for condition, and once you accept it they will take the old car away.
If the cost of repair is not greater than the worth of the car, they will fix it and not total it.

Admitting to something you did is not foolish, it's responsible.
Most likely it will be totaled out, it would most likely cost more to fix then to get a new car.
